On October 23, 2014, the Fourth Plenary Session of the 18th Central Committee of the Communist Party of China deliberated and adopted the Decision of the Central Committee of the Communist Party of China on Several Major Issues Concerning the Comprehensive Promotion of the Rule of Law. The full text of the report of the Fourth Plenary Session of the 18th Central Committee is as follows:
In order to implement the strategic deployment made by the 18th National Congress of the Communist Party of China and accelerate the construction of a socialist country ruled by law, the Fourth Plenary Session of the 18th Central Committee studied a number of major issues in comprehensively promoting the rule of law and made the following decisions.
1. adhere to the road of socialist rule of law with Chinese characteristics and build a socialist legal system with Chinese characteristics
Governing the country according to law is the essential requirement and important guarantee for upholding and developing socialism with Chinese characteristics. It is an inevitable requirement for realizing the modernization of the national governance system and governance capabilities. It is related to our party's governance and rejuvenation of the country, the happiness and well-being of the people, and the long-term stability of the party and the country.
To build a moderately prosperous society in an all-round way, realize the Chinese dream of the great rejuvenation of the Chinese nation, comprehensively deepen reforms, improve and develop the socialist system with Chinese characteristics, and improve the party's ability and level of governance, we must comprehensively promote the rule of law.
China is in the primary stage of socialism, building a moderately prosperous society in an all-round way has entered a decisive stage, reform has entered a critical period and a deep-water area, and the international situation is complex and changeable. The task of reform, development and stability faced by our party is unprecedented, and there are many contradictions and risks and challenges. The rule of law plays a more prominent and important role in the overall work of the party and the state. In the face of the new situation and new tasks, our party must better coordinate the overall domestic and international situations, better maintain and use the important strategic opportunity period for my country's development, better coordinate social forces, balance social interests, regulate social relations, and regulate social behavior. Make our society both vigorous and orderly in the profound changes, achieve economic development, political integrity, cultural prosperity, social justice, and good ecology, and achieve the strategic goal of peaceful development in our country, we must give better play to the leading and normative role of the rule of law.
Our party attaches great importance to the construction of the rule of law. For a long time, especially since the Third Plenary Session of the Eleventh Central Committee of the Party, our party has profoundly summarized the successful experience and profound lessons of my country's socialist rule of law construction, and proposed that in order to ensure people's democracy, the rule of law must be strengthened, and democracy must be institutionalized and legalized. The rule of law is determined as the basic strategy for the party to lead the people to govern the country, and the rule of law is determined as the basic way for the party to actively build socialist rule of law. At present, the socialist legal system with Chinese characteristics has been formed, the construction of a government under the rule of law has been steadily advanced, the judicial system has been continuously improved, and the concept of the rule of law in the whole society has been significantly enhanced.
At the same time, we must be soberly aware that compared with the requirements of the development of the party and the country, compared with the expectations of the people, and compared with the goal of promoting the modernization of the national governance system and governance capabilities, there are still many unsuitable and inconsistent problems in the construction of the rule of law. The main manifestations are: some laws and regulations fail to fully reflect the objective laws and the wishes of the people, and the pertinence and operability are not strong; the phenomenon of non-compliance with the law, lax law enforcement, and non-investigation of violations of the law is more serious. The law enforcement system is out of touch with powers and responsibilities, multiple law enforcement, and selective law enforcement still exists. The phenomenon of non-standard, lax, opaque, and uncivilized law enforcement is more prominent. Law enforcement, judicial injustice and corruption are strongly reflected; some members of society do not have a strong awareness of respecting the law, abiding by the law, some state functionaries, especially leading cadres, do not have a strong sense of handling affairs in accordance with the law, lack of ability, and the phenomenon of knowing the law and breaking the law, substituting words for the law, oppressing the law with power, and bending the law for personal gain still exists. These problems, which violate the principle of socialist rule of law, harm the interests of the people and hinder the development of the cause of the party and the state, must be solved with great efforts.
To comprehensively promote the rule of law, we must implement the spirit of the 18th CPC National Congress and the third Plenary session of the 18th CPC Central Committee, hold high the great banner of socialism with Chinese characteristics, and thoroughly implement the spirit of General Secretary Xi Jinping's series of important speeches under the guidance of Marxism-Leninism, Mao Zedong thought, Deng Xiaoping Theory, the important thought of "three represents" and the scientific concept of development. We will unswervingly follow the road of socialist rule of law with Chinese characteristics, we will resolutely safeguard the authority of the Constitution and law, safeguard the rights and interests of the people in accordance with the law, safeguard social fairness and justice, and safeguard national security and stability, so as to provide a strong legal guarantee for Chinese Dream, who has achieved the "two centenary" goals and the great rejuvenation of the Chinese nation.
The overall goal of comprehensively promoting the rule of law is to build a socialist legal system with Chinese characteristics and build a socialist country ruled by law. This is, under the leadership of the Communist Party of China, adhere to the socialist system with Chinese characteristics, implement the theory of socialist rule of law with Chinese characteristics, form a complete legal norm system, an efficient rule of law implementation system, a strict rule of law supervision system, and a strong rule of law guarantee system. Perfect the party's legal system, adhere to the rule of law, rule of law, and administration according to law, we will achieve scientific legislation, strict law enforcement, impartial justice and law-abiding by the whole people, and promote the modernization of the national governance system and governance capacity.
To achieve this overall goal, we must adhere to the following principles.

Comprehensively promoting the rule of law is a systematic project and a broad and profound revolution in the field of national governance, which requires long-term and arduous efforts. All comrades in the party must more consciously adhere to the rule of law, more solidly promote the rule of law, strive to realize the rule of law in all national work, and continue to advance towards building a rule of law in China.
2. and improve the socialist legal system with Chinese characteristics with the Constitution as the core, and strengthen the implementation of the Constitution
The law is the most important weapon for governing the country, and good law is the preconditions for good governance. To build a socialist legal system with Chinese characteristics, we must insist on legislation first, give full play to the leading and promoting role of legislation, and grasp the key to improving the quality of legislation. We must abide by the people-oriented and legislative concepts for the people, implement the core socialist values, and make every legislation conform to the spirit of the constitution, reflect the will of the people, and be supported by the people. It is necessary to integrate the principles of justice, fairness, and openness throughout the entire legislative process, improve the legislative system and mechanism, adhere to the simultaneous implementation of legislation, reform, abolition, and interpretation, and enhance the timeliness, systematicness, pertinence, and effectiveness of laws and regulations.

3. Deeply Promoting Administration According to Law and Accelerating the Building of a Government under the Rule of Law

Governments at all levels must persist in working under the leadership of the party and on the track of the rule of law, innovate the law enforcement system, improve law enforcement procedures, promote comprehensive law enforcement, strictly enforce law enforcement responsibilities, establish a unified power and responsibility, authoritative and efficient administrative system according to law, and speed up the construction of a government ruled by law with scientific functions, legal powers and responsibilities, strict law enforcement, openness and fairness, honesty and efficiency, and law-abiding integrity.

4. ensure fair administration of justice and improve judicial credibility
Justice is the lifeblood of the rule of law. Judicial justice plays an important leading role in social justice, and judicial injustice has a fatal destructive effect on social justice. We must improve the judicial management system and the operation mechanism of judicial power, standardize judicial behavior, strengthen supervision of judicial activities, and strive to make the people feel fair and just in every judicial case.
(I) improve the system for ensuring the independent and fair exercise of judicial and procuratorial powers in accordance with the law.
(II) optimize the allocation of judicial powers.
(III) promote strict justice.
(IV) guarantee people's participation in the administration of justice.
(V) strengthen the judicial protection of human rights.
(VI) strengthen the supervision of judicial activities.
5. Enhancing the Concept of the Rule of Law for the Whole People and Promoting the Construction of a Society under the Rule of Law
The authority of law comes from the people's inner support and sincere belief. The rights and interests of the people must be guaranteed by law, and the authority of the law must be safeguarded by the people. We must carry forward the socialist spirit of the rule of law, build a socialist culture of the rule of law, enhance the enthusiasm and initiative of the whole society to enforce the rule of law, and form a social atmosphere in which it is glorious to abide by the law and shameful to break the law. so that all the people will become loyal advocates, conscious abides and firm defenders of the socialist rule of law.
(I) promote the whole society to establish awareness of the rule of law.
(II) promote multi-level and multi-field governance in accordance with the law.
(III) build a complete legal service system.
(IV) and improve mechanisms for safeguarding rights and resolving disputes in accordance with the law.
6. strengthen the construction of the legal work team
To comprehensively promote the rule of law, we must vigorously improve the ideological and political quality, professional work ability, and professional ethics of the rule of law work team, and strive to build a socialist rule of law work team that is loyal to the party, the country, the people, and the law, in order to accelerate the construction of socialism A country under the rule of law provides strong organizational and talent guarantees.

7. Strengthen and Improve the Party's Leadership in Comprehensively Promoting the Rule of Law
The party's leadership is the most fundamental guarantee for comprehensively promoting the rule of law and accelerating the construction of a socialist country ruled by law. We must strengthen and improve the party's leadership over the rule of law and implement the party's leadership in the whole process of comprehensively promoting the rule of law.
(I) adhere to the rule of law.
(II) strengthen the construction of the party's laws and regulations.
(III) improve the thinking of the rule of law and the ability of party members and cadres to handle affairs in accordance with the law.
(IV) promote the rule of law in grassroots governance.
(V) in-depth promotion of the rule of law and strict rule of the army.
(VI) safeguard the practice of "one country, two systems" and promote the reunification of the motherland in accordance with the law.
(VII) strengthen foreign-related legal work.
Party committees at all levels must fully and accurately implement the spirit of this decision, improve the responsibility implementation mechanism of the unified leadership of the party committee, the division of labor and responsibility of all parties, and the joint management, and formulate implementation plans to ensure that various deployments are implemented.
